Election Day Flotsam and Jetsam

Have a new miscellaneous thoughts and observations post up on Substack.

Today is election day and make sure you vote. Heaven help you if you haven't already decided who you plan to vote for. That's like a person who hasn't decided what they want for lunch and has questions on every menu option. And that person is always ahead of me in line to order!

John Marshall: Definer of a Nation

"...if American law were to be represented by a single figure, sceptic and worshipper alike would agree that the figure could be one alone, and that one, John Marshall." - Oliver Wendell Homes

"Marshall's preeminence was due to the fact that he was John Marshall." - Charles Evans Hughes

"John Marshall was the fourth Chief Justice of the United States. Appointed by President [John] Adams during the waning days of his term in 1801. Marshall served as chief justice for thirty-five years. Hs tenure spanned the terms of five presidents...

...If George Washington founded the country, John Marshall defined it." - Jean Edward Smith

"A list of Marshall's great decisions reads like the ABC's of American constitutional law. Judicial review - the authority of the Supreme Court to declare acts of Congress and the executive unconstitutional - traces to his landmark opinion in Marbury v Madison. The implied power of the national government evolved from the decision in McCullough v Maryland. In the leading cases of Martin v. Hunter's Lessee and Cohen v. Virginia, the Marshall court established its jurisdiction over state courts when federal issue was at stake." - Jean Edward Smith

Had this book on my shelf for a long time and finally felt the time was right to dive in. Liking it very much and quite honestly embarrassed by my lack of knowledge about John Marshall. I'll let one of his biographers, Albert Beveridge have the final word for now:

"Such exalted encomium has been paid him, that... a kind of mythical being, endowed with virtues and wisdom not of this earth. He appears to us as a gigantic figure looming , indistinctly, out of the mists of the past,"

One more day until the election and then hopefully the incessant political ads on TV and the emails from Kamala Harris's election campaign can end. God willing! Make it so.

Once again Daylight Savings robs us of an hour as we "fall back" and change our clocks for no good reason whatsoever. It now gets darker earlier and I hate it. When we "Spring forward" and get that hour back we should just leave it there and ditch Daylight Savings once and for all.

Habits

I whole heartly endorse the James Clear book Atomic Habits. Instinctually I knew it was best to develop good habits and shed bad ones. On of the best pieces of advice I ever received was from a friend in high school who said that if you did something for 21 days straight it became a habit. I still believe that's true.

A few years ago I did a little experiment where I took some of my worse habits and gave each up for a month. I went without alcohol, then playing Keno, then smoking pot. then caffeine, and finally porn,  I was successful in giving each up for the month except porn (which I'm not sure says more about me or men in general). I did find that my use of all these were greatly reduced and many eliminated completely for long stretches.

As far as cable TV, newspapers, or network news - I gave them up decades ago and don't miss them in the least. If any of these are one of your "crutches" - try giving them up for a month. You may find you do better without them.

Friday Flotsam and Jetsam

Have a new miscellaneous thoughts and observations post up on Substack.

Want to normalize both the words "stupid" and "fat." People should strive to be neither stupid nor fat. Adhere to the Buffett/Munger admonishing "first don't be stupid" in every thing you do. And get more exercise or eat properly if you feel "fat." There should be no stigma in using either word.
